Rules for placing and fulfilling orders in the Dary pszczół store.

Effective from 6 August 2026.

These Terms and Conditions govern the use of the Dary pszczół online store, the placement and fulfilment of orders, sales contracts, customer accounts and complaints. They are available free of charge in a form that can be saved and reproduced. The Polish version is the primary version for sales in Poland; the English version is provided for convenience and must be interpreted consistently with mandatory consumer law.

1. Seller and contact details

The seller and operator of the store at darypszczol.com is Pasieka rodzinna Dary pszczół Wojciech Lisecki, address: Dyniska 8, 22-678 Ulhówek, Poland, e-mail: darypszczol@gmail.com, referred to below as the “Seller”.

You may use this e-mail address to ask about products or orders, make a complaint, submit a withdrawal statement or exercise data protection rights. The Seller communicates in Polish and, where possible, in English.

2. Definitions

  • Customer – a natural person, legal person or other entity placing an order.
  • Consumer – a natural person entering into a legal transaction with the Seller that is not directly related to that person's trade or profession.
  • Sole trader with consumer rights – a natural person entering into a contract directly related to their business where the contract is not professional in nature for that person. Consumer provisions apply to that person to the extent required by Polish law.
  • Store – the website darypszczol.com through which products can be viewed and ordered.
  • Product – movable goods offered in the Store, in particular honey or another bee product.
  • Account – a free electronic service enabling the Customer to save data and view order history.
  • Business day – Monday to Friday, excluding public holidays in Poland.

3. Technical requirements and acceptable use

To use the Store you need an Internet-connected device, a current browser supporting HTML5, CSS and JavaScript, cookies necessary for the cart and session, and an active e-mail address. A carrier's external map may need to be loaded to select a pickup point.

The Customer must provide true, current and sufficient information. It is prohibited to submit unlawful content, circumvent security, disrupt the Store or infringe the rights of others.

The Seller uses appropriate technical and organisational safeguards, but Internet use carries common risks such as malware and phishing. The Seller will never ask for an Account password by e-mail.

4. Products, prices and availability

Product pages, including photographs, composition, weight, variant, price and availability, are an invitation to place an order. Photographs are intended to show products faithfully, but natural bee products may vary in colour, consistency or degree of crystallisation. Honey crystallisation is a natural process and is not in itself a lack of conformity.

Prices are stated in Polish zloty and are the final Product prices payable by the Customer, including taxes where applicable. Delivery and any payment-method cost are displayed separately before the order is placed. The price in the final order summary is binding for that order.

Promotions and reductions apply on the terms shown with the Product and cannot be combined unless stated otherwise. A later price change does not affect a concluded contract.

The Store prevents ordering more units than are shown as available. If, exceptionally, inventory data prove incorrect, the Seller will promptly offer fulfilment of the available part, a substitute or cancellation of the unavailable item. A change requires the Customer's consent and any amount collected for an unfulfilled part will be refunded.

5. Ordering and conclusion of the contract

  1. The Customer selects a Product and variant, quantity, and adds it to the cart.
  2. The Customer reviews products, quantities, prices and total weight in the cart.
  3. At checkout the Customer enters the required information, selects delivery and payment, reads these Terms and reviews the final summary, including the total price.
  4. Clicking “Order with obligation to pay” places an order carrying an obligation to pay.
  5. The sales contract is concluded when the Store successfully accepts the order, assigns an order number and displays confirmation. Confirmation is also sent to the e-mail address provided.

Information can be corrected before submission by returning to the relevant step. To correct an obvious error after submission, contact darypszczol@gmail.com as soon as possible. Whether a change remains possible depends on the fulfilment stage and does not restrict statutory rights.

The Seller may contact the Customer if data are incomplete, payment is unconfirmed or fulfilment as selected is impossible. The Seller may refuse fulfilment only for a justified reason, including unavailability, inability to deliver, failure to pay within the required period or a reasonable suspicion of abuse. Any collected amount due for an unfulfilled order will be refunded.

6. Payment

Methods currently available are displayed at checkout. They may include:

  • ordinary bank transfer using the account and reference in the order confirmation;
  • payment on delivery where supported by the selected delivery method;
  • online payment on the secure hosted page of Stripe or Autopay, only when the relevant method has been activated in the Store.

The selected method, full amount and any related charge are shown before submission. For a bank transfer, fulfilment may begin after funds are credited. If payment is not received by the time stated in the instructions, the Seller may first make contact and set an additional period before cancelling the order.

A payment provider may apply its own security requirements and terms. The Seller does not receive full card details. A failed or interrupted online payment does not remove statutory rights; contact the Seller to retry or arrange another method.

7. Delivery and collection

Delivery is offered within Poland using the options currently active at checkout: InPost Paczkomat or PaczkoPunkt, Pocztex PUNKT or AUTOMAT, courier, or free personal collection at Dyniska 8, 22-678 Ulhówek.

The delivery price is calculated automatically under the current rules, which may take into account the method, weight, order value, Customer type and payment on delivery. The binding cost and total price are always displayed before the “Order with obligation to pay” button is used.

A standard parcel may weigh up to 20 kg. For an order above 20 kg but no more than 40 kg, the Store explains that two parcels are needed and asks for express consent. The Store does not charge a second delivery fee merely because the order is split. Delivery above 40 kg must be agreed individually before fulfilment.

The estimated time or the method of calculating it is displayed at checkout or in the confirmation. Unless otherwise agreed, the Product will be delivered without undue delay and no later than the deadline required by applicable law. Timing may depend on receipt of prepayment and the carrier's working days.

The Customer must provide accurate recipient information and select the correct point. If a parcel is returned because it was not collected or the Customer supplied incorrect details, the Seller will contact the Customer. The actual additional cost of re-dispatch may be agreed unless the Seller or carrier caused the return.

Customers are encouraged to inspect the parcel and, if damaged, make a carrier report or take photographs. Failure to do so does not deprive a Consumer of the right to complain.

8. Customer Account

An Account is not required to buy. Registration and maintenance are voluntary and free. The Customer enters the required data, sets a password and accepts these Terms and the Privacy Policy. The Account contract is concluded for an indefinite period on successful registration.

The Customer must keep the password confidential and promptly report suspected unauthorised access. Account data can be updated. Deletion may be requested by e-mail; it will be performed without undue delay except for data that the Seller must retain by law or to establish, pursue or defend claims.

The Seller may suspend or terminate an Account for a material breach of law or these Terms after asking the Customer to stop the breach, unless immediate action is needed for security. Existing sales contracts and Customer rights remain unaffected.

Any benefits for signed-in Customers, including different delivery thresholds or rates, are shown in the Store and do not become a permanent entitlement unless applied to a particular order.

9. Right to withdraw

A Consumer and a sole trader with consumer rights may withdraw from a distance contract without giving a reason within 14 days after the Consumer or a designated third party other than the carrier takes possession. Where one contract covers goods delivered separately, the period starts when the last item, lot or piece is received.

It is sufficient to send an unequivocal statement before the deadline to darypszczol@gmail.com or by post to the Seller. The model in section 15 may be used but is not mandatory.

The Product must be sent or handed back without undue delay and no later than 14 days after notice, to: Pasieka rodzinna Dary pszczół Wojciech Lisecki, Dyniska 8, 22-678 Ulhówek, Poland. The Consumer bears the direct return cost unless the Seller agreed to bear it or failed to disclose this obligation.

The Seller will refund all payments received, including the cost of the least expensive ordinary delivery offered for the order, no later than 14 days after notice. Any extra cost of a more expensive delivery option is excluded. The same payment method will be used unless the Consumer expressly agrees to another cost-free method. The Seller may withhold reimbursement until the Product is received or evidence of return is supplied, whichever occurs first.

The Consumer is liable only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product.

Exceptions

The right to withdraw is excluded only in cases provided by law, particularly a contract for:

  • a Product liable to deteriorate or expire rapidly;
  • a sealed Product which is not suitable for return due to health protection or hygiene reasons and was unsealed after delivery;
  • a non-prefabricated Product made to the Customer's specifications or clearly personalised;
  • a Product which, after delivery, becomes inseparably mixed with other items because of its nature.

Being food does not, by itself, remove the right to withdraw. Each exception is assessed individually according to the Product and the state of its packaging.

10. Conformity and complaints

The Seller is liable to Consumers for conformity under the Polish Consumer Rights Act. A Product should match its description, type, quantity, quality and other agreed features, be fit for ordinary purposes, and be supplied with the agreed elements and packaging.

The Seller's statutory liability covers a lack of conformity existing on delivery and revealed within two years, without affecting a longer stated best-before or durability period.

A complaint may be made in any form, particularly by e-mail to darypszczol@gmail.com or by post. To speed up handling, provide the order number, contact details, description, date noticed, requested remedy and, where possible, photographs. A receipt, agricultural sales document, original packaging or photographs cannot be the sole condition for accepting a complaint if the purchase can be proved otherwise.

The Consumer may request repair or replacement. The Seller may use the alternative if the chosen remedy is impossible or disproportionately costly, and may refuse both only where permitted by law. For food, repair may be inherently unsuitable, so replacement, price reduction or reimbursement will usually be appropriate.

The Consumer may request a price reduction or terminate the contract in the circumstances set out by law, including where the Seller refuses or fails to restore conformity within a reasonable time and without significant inconvenience, the lack persists, or it is sufficiently serious to justify an immediate reduction or termination. Termination is unavailable for an insignificant lack of conformity.

The Seller responds to a Consumer complaint within 14 days of receipt. The Seller bears the costs of repair, replacement, collection and transport of a justified complaint. Nothing here limits more favourable mandatory rights.

11. Sales document

Order and payment details are supplied electronically. The Seller issues the form of sales document required by the Seller's actual tax status and applicable law. The Store system may use the administrative label rachunek rolniczy (agricultural sales document), but that label alone does not determine the document's tax classification. The order confirmation is not a VAT invoice unless expressly stated otherwise. The document type does not limit Customer rights, and a complaint cannot depend solely on producing one particular document where the contract can be proved otherwise.

12. Alternative dispute resolution

After the complaint procedure, a Consumer may use Polish out-of-court dispute resolution, including the relevant regional Trade Inspection authority, its permanent consumer arbitration court, or a municipal or district consumer ombudsman. Information and a list of entities are available at polubowne.uokik.gov.pl.

Participation is voluntary. If a complaint is rejected, the Seller will provide on paper or another durable medium information about the competent entity and whether the Seller agrees to participate. Either party may still bring a claim before a competent court.

The former EU ODR platform was discontinued on 20 July 2025, so these Terms do not link to an inactive platform.

13. Personal data and cookies

Processing purposes, legal bases, recipients, retention, cookies and user rights are explained in the Privacy Policy. Data are used only where a legal basis exists, particularly for the Account, order, payment, delivery, complaints and security.

14. Accessibility, amendments and final provisions

The Store is designed for keyboard use, clear messages, suitable contrast and assistive technologies. Report an accessibility barrier to darypszczol@gmail.com, identifying the page and the access needed. The Seller will seek to provide the information or service by an alternative method.

The version accepted when an order is placed governs that sales contract. The Seller may amend these Terms for a valid reason, including changes in law, Store functions, payment or delivery methods, security requirements or Seller details. Amendments do not affect acquired rights or concluded contracts.

Account holders will be informed on a durable medium, with the notice required by law, of amendments affecting the Account service. A Customer who does not accept may terminate the Account contract free of charge.

Polish law applies, including the Consumer Rights Act, Civil Code, Act on Providing Services by Electronic Means and data protection law. This choice does not deprive a Consumer of protection granted by mandatory law of their habitual residence where applicable.
